SERVICES PLATFORM PRIVACY INFORMATION

Kollective collects information under the direction of its customers, but has no direct relationship with the individuals whose personal data it processes. Kollective works with its customers to help them provide notice to their users concerning, the purpose for which personal information is collected. In order to request additional information about the Services or to register to use the Services, Kollective requests that you provide your contact information, such as name, company name, address, phone number, and email address (“Contact Information”). In addition, Kollective may ask you to provide information about your company, such as annual revenues, number of employees, or industry (“Firmographic Information”). For security purposes, you may also be asked to create user names and/or passwords (“Passwords”) in order for you or your company’s personnel to use the Services. In your use of the Services, you may upload your proprietary data and/or content to the Services (“Content”). Our Service Platform uses cookies only for authentication, not for any other purpose such as tracking web activity. The platform collects and reports on information such as usage information (how videos are consumed), delivery information (how videos get delivered) and node information (machines checking in, telling us that they are active and seeing if there are any updated policies to download). With respect to data that is stored on end user machines, we do track what VoD videos are being stored locally, but only those videos from which Kollective is the provider. This information is stored in a local database (called zdata) and we only use that information to approximately fix peers to one another.

CHOICE

We collect information for our customers. If you are a user of one of our customers and would no longer like to be contacted by one of our customers that use our Services, please contact the customer that you interact with directly. SERVICE PROVIDER, SUB-PROCESSORS/ONWARD TRANSFER

Kollective may transfer personal information to companies that help us provide our services. Transfers to subsequent third parties are covered by the service agreements and provisions in this Policy regarding notice and choice and the service agreements with our customers.

ACCESS TO DATA CONTROLLED BY OUR CUSTOMERS

Kollective acknowledges that you have the right to access your personal information. Kollective has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the Kollective customer (the data controller). If the Customer requests Kollective to remove the data, Kollective will respond to their customer’s request within 30 business days.

Data Retention – Kollective will retain personal data we process on behalf of our customers for as long as needed to provide services to our customers. Kollective will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Security – The security of your personal information and our customers’ information is important to us. The Services - As part of using the Services, you or your Company’s employees (“Service Users”) may be required to download and store a copy of the Kollective desktop client application (the “Kollective ECDN Agent”) on each Service Users’ machine through which such Service User intends to access the Services. The Kollective ECDN Agent facilitates your access to Content by communicating with Kollective’s servers and other Service Users’ machines. As part of its functioning, the Kollective ECDN Agent transmits to Kollective’s servers certain information regarding your use of the Services, such as Content viewed, length of time using the Services, and speed of Content delivery (“Usage Data”). Usage Data is used by Kollective only in connection with operating and supporting your use of the Services, facilitating your continued paid use of the Services through a further agreement with Kollective, and improving the Services generally. In addition, Kollective may from time to time provide Usage Data in aggregated form to other parties for marketing, advertising or other use.

• Data portability
You have the right to receive the data you have provided to us and that we process based on your consent or to fulfill the contract in a standard, machine - readable format and within the scope of the technically feasible to request direct transmission of this data to third parties, Art 20 GDPR.

All requests will be responded to within a reasonable timeframe not to exceed 30 days.

ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION

Upon request Kollective will provide you with information about whether we hold any of your personal information. If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, or delete it by emailing us at privacy@kollective.com or by contacting us by telephone or postal mail at the contact information listed below. We will respond to your request for access within 30 days or within reasonable timeframe.

Kollective acknowledges that you have the right to access your personal information. Kollective has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the Kollective customer (the data controller). If the Customer requests Kollective to remove the data, Kollective will respond to their customer’s request within 30 business days.

RIGHT TO COMPLAIN TO THE DATA PROTECTION AUTHORITY

If you believe that our data processing is unlawful or we have not granted the rights described above to the extent necessary, you have the right to contact the relevant data protection authority.

INTERNATIONAL TRANSFERS FOR PERSONAL DATA

Your Personal Data may be collected, transferred to and stored by us in the United States and by our affiliates and third party subprocessors that are based in other countries.

Therefore, your Personal Data may be processed outside your jurisdiction, including in countries and jurisdictions that are not subject to an adequacy decision by the European Commission or your local legislature or regulator, and that may not provide for the same level of data protection as your jurisdiction. We ensure that the recipient of your Personal Data offers an adequate level of protection and security, for instance by entering into the appropriate back-to-back agreements and, if required, standard contractual clauses or an alternative mechanism for the transfer of data as approved by the European Commission (Art. 46 GDPR) or other applicable regulators or legislators. Where required by applicable law, we will only share, transfer or store your Personal Data outside of your jurisdiction with your prior consent.

E.U.-U.S. PRIVACY SHIELD FRAMEWORK

Kollective participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss –U.S. Privacy Shield Framework. Kollective is committed to subjecting all personal data received from European Union (“EU”) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to the Framework’s applicable Principles. Kollective is responsible for the processing of personal data it receives under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. We comply with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Kollective is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Kollective may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website at https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
